In Vancouver, British Columbia on September 3, 2025, Imperial Metals Corporation (TSX:III) revealed that the Xatśūll First Nation has lodged a notice of appeal to challenge Justice Tammen's August 6, 2025 dismissal of their petition for judicial review. This petition was in relation to the approval granted by the Minister of Mining and Critical Minerals and Minister of Environment and Parks on March 27, 2025, for altering the Mount Polley mine's Mines Act Permit to allow construction of the tailings storage facility at a height of 974m. Xatśūll is calling for the Decisions to be revoked and seeks various declaratory relief measures through the appeal.
